Circular No. 102026TT-BKHCN Providing Guidance on Industrial Property Procedures in Vietnam
On March 31, 2026, the Ministry of Science and Technology of Vietnam issued Circular No. 10/2026/TT-BKHCN, providing detailed guidance on the implementation of certain provisions of the Law on Intellectual Property and Decree No. 65/2023/ND-CP, as amended by Decree No. 15/2026/ND-CP, Decree No. 33/2026/ND-CP, and Decree No. 100/2026/ND-CP.
The Circular sets out detailed procedures relating to industrial property rights, including applications for inventions, industrial designs, layout designs, trademarks, and geographical indications. It also provides guidance on procedures for maintaining, renewing, amending, terminating, or invalidating protection titles, as well as procedures for assignment of industrial property rights.
In addition, the Circular regulates the filing and processing of complaints related to industrial property procedures, rules on authorization and representation, publication in the Industrial Property Official Gazette, recording in the National Register of Industrial Property, industrial property representation services, and the provision of industrial property information.
